PLEASE READ THIS PRIVACY POLICY AND THE PIXEL UNITED TERMS OF SERVICE PRIOR TO USING, ACCESSING OR DOWNLOADING ANY PIXEL UNITED WEBSITE, APPLICATION OR SOFTWARE.

Pixel United™ develops and publishes social games for the web and mobile devices. “PxU,” or “we” or “our” or “us” refers to Pixel United, and any of its affiliates, subsidiaries and/or its parent company (collectively, “PxU” or “Pixel United”).

This Privacy Policy applies to Personal Information that PxU collects, uses, discloses, transfers, stores and handles, including Personal Information collected through our websites. The controller of Personal Information we collect is the entity in your country listed in the “Contacting Pixel United & Local Data Controllers” section below.

In accordance with the General Data Protection Regulation, PxU has appointed Plarium Europe S.a.r.l to be its representative in the European Union for data protection purposes. You will find contact details of our data protection representative further down in this Policy under the section “Additional Questions – Contact Us”.

This Privacy Policy does not apply to the digital business subsidiaries of Pixel United such as Big Fish Games, Product Madness, and Plarium, which have their own privacy policies. In this policy, “Personal Information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, directly or indirectly, and any other information that is deemed personal information under applicable law.

This Privacy Policy explains the information we collect, and how we collect, use and, in certain circumstances, share your information in connection with the Service we provide you. Please read this Privacy Policy carefully before using the Service, and if you have any questions, feel free to contact us at any time or by emailing privacy@aristocrat.com at any time.

We may collect the following categories of personal information in the ways described below:

I. Information We Collect and How We Use It

We automatically collect some information when you access the Service and collect other information when you voluntarily submit it to us (including where you choose to share information with us through third party partners). If you elect not to provide certain information, you may be precluded from participating in some of the Service.

A. Information You Provide

There is no cost to access the Service. However, we may collect information from you when you access the Service including, for example:

  • Registration information (identifiers such as your name, initials, personal email and/or postal address, telephone number, business email and/or postal address, business phone number, emergency contact information);
  • Demographic information, such as your gender, age, nationality, date of birth, height, weight, marital status, number of children;
  • Inferences based on the information described above and other information described in this Privacy Policy.

Sometimes we collect information about you from other sources, for example, when someone provides your email address to us to invite you to join the Service.

To the extent you provide information about friends and family members, you agree to provide such individuals with this Privacy Policy and to obtain their consent to provide the information.

We may also aggregate information from these categories for the purposes described below and to otherwise improve the Service.

B. Automatically Collected Information

We may automatically collect information from you when you access the Service. This information is collected by PxU or by placing certain data files on your computer or mobile device. These data files may be cookies, other local storage technologies, or other technologies (collectively, “Cookies”).

PxU collects information about your use of the Service, including, without limitation, internet or other electronic network activity information about your access of the PxU website, such as internet protocol addresses, browser type, browser language, referring / exit pages and URLs, other browser history, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, payment events, and related date and time information. This information allows us to improve the Services as well as to communicate with you about customer support and to advise you of other products or services that may be of interest to you.

When you access PxU offerings via a mobile device, we and our service providers may receive information about your geolocation (based on your IP address) and your mobile device, including various identifiers associated with your device (such as an advertising identifier and other identifiers that directly or indirectly identify your device), hardware type, the version of your operating system and your in-game activity. We may also collect, depending on the capabilities of your mobile device, information about the wifi routers closest to you, IDs of cell towers closest to you and the strength of your wifi or cell signal. While we use this information to return an estimated location, geolocation data may not be accurate. We and our service providers may use this information to provide you with personalized advertising and other content, including advertising and content based on your location.

If you do not want us to collect this information, please do not access our website.

II. Use of Information

A. Purposes for Which Information Is Collected, Used, and Disclosed

We may use the information we collect for our general commercial or business purposes such as to improve and grow our business and to offer you our own, our affiliates’ or third party products or services that we think you may find of interest. The purposes for which we collect, store, use and disclose information in particular include:

  • Providing you with the Service, including allowing you to register and correctly identifying you, as well as providing you with the core game experience, pursuant to our Terms of Service;
  • At your request, responding to inquiries, resolving service problems, handling complaints, correcting errors in the Service and communicating with you about the Service;
  • With your consent, share your information with third party marketplaces and service providers in order to provide you with targeted advertising and checking whether our advertising is effective;
  • With your consent, contacting and, if necessary, reminding you that you have been invited by one of our players to join PxU;
  • Based on our legitimate business interest, providing you with, or communicating with you about, PxU-specific advertising, products, events, and promotional information in connection with the Service (including contests and other PxU promotions), administering satisfaction or other surveys, notifying you of new product releases, service notifications, soliciting your feedback and input, and for other marketing or business purposes;
  • Based on our legitimate business interest, offering personalized services (other than advertising) and supporting or learning about your needs as a customer;
  • Based on our legitimate interest, detecting and preventing fraud or misuse of the Service;
  • Based on our legitimate interest, for business research and development of new products or services;
  • In order to comply with our legal obligations, establish and defend any legal claims, and in some cases, including where identified above, our basis for processing will be because you have consented to our use of your information; and
  • For purposes unrelated to those described in this Privacy Policy by first notifying you and, where required, offering you a choice as to whether or not we may use your personal information in this different manner.

B. Sharing of Personal Information

We may reveal or share the categories of personal information listed above to other companies of our group and to unaffiliated third parties for the following purposes:

  • If you request it or authorize it;
  • If the information is provided to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our Terms of Service or other agreements, or to protect our or our affiliates’ rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection, etc.);
  • If the disclosure is done as part of a purchase, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, customer information may be one of the transferred assets);
  • If the information is provided to our agents, outside vendors or service providers to perform functions on our behalf (e.g., analyzing data, providing marketing assistance, providing customer service, processing orders, etc.); or
  • As otherwise described in this Privacy Policy.

Your personal information may be processed by staff operating inside or outside the United States of America, by persons who work for us or for one of our suppliers or related companies.

We may share your information with third parties (including affiliates) for their direct marketing purposes but will only do with your consent. You will receive a separate notice and consent form to exercise your choice. If you have provided consent, you can at all times withdraw that consent by immediately updating your privacy settings from within the game or you can submit an email via this form.

We may release your information, when legally required to do so or to verify or enforce compliance with the policies governing our Service and applicable laws. We may also disclose such user information whenever we believe disclosure is necessary to protect the rights, property or safety of PxU or any of our respective affiliates.

We may disclose your aggregate, deidentified, or otherwise non-personal information, such as usage statistics of our Service, to our affiliates and third parties.

Be advised that if you send messages or post material containing personal information, that information may be collected and used by others.

We will put in place contractual protections to keep your information secure as required by applicable data protection laws.

1. International Transfers

The information that we collect from you may be transferred to and stored in the United States, European Economic Area, the UK, or Brazil, or transferred to, accessed from and/or stored at, a destination outside the United States, European Economic Area, the UK, or Brazil including Australia, India, Belarus, Ukraine, Philippines and Israel. These countries of destination may not have the same comprehensive data protection laws than the country of your residence. In these instances, we implement measures, as required by applicable law, such as standard contractual clauses or data processing agreements, to ensure that any transferred personal information remains protected and secure.

C. Retention of Your Information

We may retain copies of your information for so long as reasonably necessary for the purposes set out above, in accordance with applicable laws, or delete it earlier (either in whole or in part) if we determine, in our sole discretion, that the same constitutes a violation of PxU’s Terms of Service, this Privacy Policy, or for any or no reason. III. Access to Your Personal Information and Your Rights and Choices

A. Data Protection Rights

In accordance with applicable law, you may be entitled to request restriction of processing of your information, and to request access to, correction, erasure, and portability of your information. If we collect or process information based on your consent, you have the right to withdraw your consent at all times. If you are aware of changes or inaccuracies in your information, you should inform us of such changes using the details in the “Additional Questions – Contact Us” section below, so that your information may be updated or corrected.

We will not discriminate against you for exercising your rights and choices except where permitted by law. For example, some of the functionality and features on the Service may change or no longer be available to you if you have requested that we delete your information.

Once we receive your request, we may verify it through your account or by requesting information sufficient to confirm your identity. If you would like to use an agent authorized in accordance with applicable law to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to exercise rights on your behalf.

Our response to your request is provided to you on a free-of-charge basis. We will only charge you if your request is manifestly unfounded or excessive.

You can terminate your account at any time which will remove your profile and other personal information from view. We will use reasonable efforts promptly to amend or delete your records as requested. PxU may (but is not obligated to) keep information about you following termination of your account. Your information will generally be permanently deleted or anonymized one month after your request to terminate the account. In some cases we may be legally required to maintain certain records of your personal information, in which case we may not be permitted to delete your information. If you wish to terminate your account, exercise any of your rights, or if you have any other questions or concerns about your personal information please contact us or by emailing privacy@aristocrat.com.

If you are unhappy about how we handle your personal information or how we dealt with your request, you have the right to lodge a complaint with the data protection authority in your Member State of residence.

B. California Residents: Your California Privacy Rights

California residents who have an established business relationship with PxU may choose to opt out of PxU’s disclosure of personal information about them to third parties for direct marketing purposes. As detailed above, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. If you choose to opt-out at any time after granting approval you can submit an email to us via this form.

PxU will never sell any information that identifies you personally, like your name, email address, or phone number. We do work with advertising partners who use Cookies and device identifiers as described in this Policy to show ads that are targeted to your interests. Some of these disclosures may be considered sales under California law. Please see the relevant sections of this Policy for information about how your information is shared with third parties and the choices that may be available to you, including instructions on how to opt out of these disclosures. As described above, PxU allows third parties to access information about your use of the Service through Cookies. Some of these companies are members of the Network Advertising Initiative, which offers a single location to opt out of ad targeting from participating companies.

C. Direct Marketing

We will obtain your prior consent before sending you marketing communications where required by law. You can choose not to receive emails from us by “unsubscribing” using the instructions in any email you receive from us. This will not stop us from sending emails about your account or your transactions with us.

You may also opt-out of receiving marketing materials from us by updating your privacy settings via the privacy section in the game you are playing by contacting PxU customer service.

If you have registered to receive SMS messages, you can opt out of receiving SMS messages (text messages for example) by texting back STOP to the number we send the text from for that particular SMS Message program. In some cases a preferences page may also be available. When we receive an opt-out message from you for SMS messages, we may send a message confirming our receipt of your opt-out.

If you have been invited to join PxU you are provided with the option not to receive further invitations from PxU. If you choose to opt-out at any time after granting approval you can update your privacy settings immediately within each game or by contacting PxU customer service.

IV. Children’s Privacy

The Service is designed and intended for users who are 18 and older only. Children and teens are not permitted to use the Service and PxU does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register for use of the Service. If you are under 18, please do not attempt to register for, or otherwise use, the Service or send any information about yourself to PxU, including your name, address, telephone number, or email address. In the event that PxU learns that PxU has inadvertently collected personal information from a child under age 18, PxU will delete that information as quickly as possible.

If you are a parent or guardian who has discovered that your child has submitted his or her personal information to PxU, PxU will make commercially reasonable efforts to delete the information from its database, at your request. To request the deletion of your child’s information, please contact PxU customer service and ensure you include the name and password that your child submitted.

VI. Security

PxU uses reasonable technical, administrative and physical measures to protect information contained in our system against misuse, loss or alteration.

Please do not share your log-in information with others.

Email and instant messaging are not recognized as secure communications, so we request that you not send private information to us by email or instant messaging services. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our Service; any transmission is at your own risk. PxU cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We may permit others to link to our Service or to post a link to their site on our Service. We do not endorse these sites and are not responsible for other sites or their privacy practices. Please read their privacy policies before submitting information.
